Sniping out of his own uncap is not against the rules however if he is sniping into someones uncap thats against rules.

Thank you for pointing out that he himself is fair game in that scenario! I fly the attack chopper a lot (sometimes the jet) and upon spawning in the chopper/jet I've been sniped before I can even take off :(

Yea, you can't attack people in the Uncap. But if someone is in their uncap attacking you, they are free game for a bullet from your weapon.
