Question about BF4 server spawnkilling

Its not a report, since I couldnt take evidence video at that game cause of some software malfunction.

I was playing jet on altai range and there was an expert pilot named 'oX_-oBIGBOSS-FoX' with several hundred hours on enemy jet. There was no way we could take him down in 1:1 dogfight so my squadmate and I decided to go 2:1 and I spanwed first on one jet and circled at uncap. Somehow, he figured out we are working together and started spawnkilling us, where he acknowledged he's doing that because he's afraid of 2:1. Sometimes, he explicitly spawnkilled 0.1 second after I spawned, and some other times, he sneaked up behind me circling at the uncap, where I was waiting for my wingman.

His excuse was that I already spawned while ago, but I have been circling at the very position I spawned. I am wondering if this 'no attack to uncap unless its return fire' rule applies to jets too. I really needed my squad wingman so it was not intentional camping at all and i didnt fire a single shot.

So in summary, does uncap protection apply to jets too? thanks
 
If you are about take off, nobody should interefere with that until you are fully in the air. If you are going back to your uncap base after being in the air for a bit that does not mean they cannot attack you. They sure can.

So I guess in the maps where jets spawn in the air, I guess there's no safe place to wait for wingman?
If there isnt, I think there should be a rule against this. He frequently camped at our base, flying at low altitude to avoid radar detection, and when we spawned, he just chase us straight so that he gets our back at the very moment we spawn. I think there should be a fix in rule in this case. Thanks for your time.

So who is that doing the loops and attacking when the jet spawns in the air? That is considered attacking the uncap or attacking the jet while in their uncap base.

Edit: this is not even you in our server is it?
 
If you take off out of your base you are onLay safe if you loiter over the airfeild and the vehicle spawn, once you leave that area you are fair game. If you shoot at anyone at anytime while in the uncap, you are considered fair game to be engaged.
